You are intoxicated in Texas if you are driving a motor vehicle in a public place, and you have lost your normal mental or physical abilities due to drugs or alcohol. Click on the law link to see the actual Texas law. You are assumed to be intoxicated if your BAC, Blood Alcohol Concentration, is 0.08 or greater. Your license could be suspended if you are arrested for a DUI/DWI (Driving Under the Influence / Driving While Intoxicated).
